The Firearms Freedom Act (FFA) is sweeping the Nation.
June 3rd, 2010
Originally introduced and passed in Montana, the FFA declares that any firearms made and retained in-state are beyond the authority of Congress under its constitutional power to regulate commerce among the states.
Following initial Montana enactment, clones of the Firearms Freedom Act have subsequently been enacted in Tennessee, Utah, Wyoming and South Dakota, and other clones have been introduced in the legislatures of twenty-some other states.
The FFA is primarily a Tenth Amendment challenge to the powers of Congress under the “commerce clause,” with firearms as the object – it is a state’s rights exercise.

The Federal Court is respecting the Freedom Firearms Act in all states after mock cases in court. All intending states should push the legislation through.

I agree, that is a nice block of green states! However, you need to get these State’s out of this lawsuit with Florida over the ObamaCare issue. I’m working on a document that explains why, but if you want to sue, do so in your own jurisdiction, not one under an Attorney General you didn’t elect and in a jurisdiction far removed from you. Florida’s legal standing is quite a bit different than any of these green states, it is an incredibly risky and poor judgment to enjoin them over the very meaning of the Commerce Clause in Florida, a post-Reconstruction State with a severally diminished legal capacity.

You need to use a color other than purple on the map. On low-resolution devices it is the same as the blue. I’d suggest cyan instead.

What can you do with places like New York and California that refuse to honor the Constitutional rights of its residents?
It seems to me they are both violating the second amendment of the Constitution by either an outright ban or there are so many regulations that limit the possession of firearms to be ridiculous. ie violating; “Shall not be infringed”

I am a US expat living in Canada. I have passed the Canadian background check to own, purchase and use firearms for the purpose of hunting and target shooting. I do not have a US address. Eric Holder USAG has seen fit to suspend my second amendment rights. On the FFA form when a firearm is purchased you must fill in your US address. As I do not have a US address I can not fill out the required form. So I can not purchase a firearm in the United States anywhere. Nowhere in the bill of rights does it say that my second amendment rights can be suspended because of where I live. This pisses me off. If I come to Montana can I buy a gun at this time without filling out the required FFA form?
One other thing, I have contacted Allen Gura an attorney who is suing Eric Holder on behalf of non resident US citizens who wish to purchase firearms in the United States but can’t because of their lack of a US address. I guess he has added me to the list of individuals who are suing to get their gun rights back. Allen Gura currently has or will have this lawsuit befor the Supreme Court.
What can anyone tell me about AR legislation? I see the state is shaded purple meaning FFA pending. Any updates on this one?

Shot down by Gov. Henry here in Oklahoma. I think he had a valid point, and with a couple new lines in the legislation it is set to pass in OK. We also passes Open Carry last week and are waiting on Gov. Henry.

Our biggest neeed is to allow God to be at the helm of this Nation. This It would not have been a problem to pass as Oklahoma already has law that controls firearms from getting into the hands of the lawless but that is not where the lawess get guns now is it? Passing could have been held off until proper Oklahoma law was in place to compensate for the loss of Federal law being put back into the proper hands. We all know that the criminals will always have the best full auto weapons anyway. It is not the Gun that kills any more than it is the spoon’s fault for overweight people. There are many ways to replace the gun with other means to kill. It is not the lawfull that pose a threat to our Law Enforcement. It has already been proved that removing guns from the lawful does not reduce crime and It has been proven that crime goes up. It would not be a problem to control Oklahoma manufactured arms and it would have given us an ecconimic boost that we could really use as it will to other states that now will be able to have new business in their states. I see this as a means to take some of the Teeth our of our government and we all know that they need control in several areas. Most of us that pay attention to what they do are scared of our own Government. That is a shame to say but look at how they have kept the Constitution. They have spent our Social Security that you and I put into the system on many other things and they have broken numerious laws just lately that were against the Constitution. They are tightening our Freedoms regularly. If all the States would follow this, we would all be able to have our needs meet at the state level and if you did not like living in your state because they did not make the laws you like, you could move to one who allows your desires to be fulfilled. State control was always ment to be in the hands of that state. It is the only reason for the 2nd Ammendment. I figure he will shoot this down until he is removed from office. I took an oath when entering the service that I would uphold and defend the Constitution to the death and I always will. The Constitution is not a complicated document but Lawyers like to spin and twist words. Look at what the Dream Team did for OJ. I am proud to be an Okie and a part of the USA. If you check the most of the people who wish to rewrite the Constitution, you will find that they have never served to defend it. Go Army – First Calvery. God, Please Bless America before it’s too late.

Waiting for Illinois to even think of any such legislation is as searching for Hen’s teeth. Illinois is, as usual, on the hind Teat of a totally dry Sow. As long as Chicago’s Daley land is part of Illinois the citizens of Illinois will continue to have their constitutional rights denied.

I believe the Fire Arms Freedom Act is far more important than originally believed. I beleive that States have the primary responsibility to legislate rules and regulations of ALL intrastate commerce WITHIN their boundaries. Specifically, the manufacture and sale of goods and items to end user consumers WITHIN a state do not accrue Federal jurisdiction. If that consumer should later move to another state and take his firearm with him, then perhaps the Fed has some jurisdiction, but not before. The same should be true for most other products as well. Items intended for sale to consumers in other states would be governed by the Commerce clause. However, the 2nd Amendment applies to all jurisdictions within the country. When States ratified the US Constitutioin, they ratified the whole thing. They made no statement indicating their ratification omitted the 2nd Amendment. Therefore, the States opted to incorporate the 2nd Amendment along with the rest of the Constitution. It’s just plain nuts to claim that ANY part of the Constitution does not pertain to any State. Remember, the Constitution is intended to LIMIT the Federal Government. Legal obfuscation to the contrary is BS.

This is just a stupid waste of state taxpayer money at a time when states have little money to waste. The Supremacy clause has already been tested many times in court, and it’s considered settled law. The ignorant dilettantes who believe it’s worth fighting this battle again merely to make a point are costing us all a lot of money. And they’ll accomplish nothing. The Tenth Amendment argument has already been argued (and lost) far too many times.
Good. Now we can have even more wives or husbands shot by their spouse and children killing or maiming each other by LEGAL firearms. Get some common sense, people. Your “gun in every room in the house” campaign is killing a lot of innocent people.

Texas has never been as firearms friendly as people assume. Most people act surprised when they find out open carry, allowed in most of the South West, has just about NEVER been allowed in Texas nor does it look forthcoming. Perry has never been pro-gun. Most of our republicans are RINOS.

Only Bright Spot of late in Texas is my county, HAYS, is looking to chip in on a full range shooting sports complex along with 4-H. Perry and TSRA/NRA have been basically minimal to no help on this as well. Seems everybody got happy when CHLs became available and then lost interest in pushing any harder on anything else.
