The Firearms Freedom Act (FFA) is sweeping the Nation.
June 3rd, 2010
Originally introduced and passed in Montana, the FFA declares that any firearms made and retained in-state are beyond the authority of Congress under its constitutional power to regulate commerce among the states.
Following initial Montana enactment, clones of the Firearms Freedom Act have subsequently been enacted in Tennessee, Utah, Wyoming and South Dakota, and other clones have been introduced in the legislatures of twenty-some other states.
The FFA is primarily a Tenth Amendment challenge to the powers of Congress under the “commerce clause,” with firearms as the object – it is a state’s rights exercise.

Being an old man and having witnessed the usurpation of all rights, not only those pertaining to firearms, I can only conclude that the present revolution that we are witnessing will come in only two forms. It will be a no shot fired one, in which the people will remove those from office and replace the scalliwags with those who will start dismantling our socialist republic at all levels, federal, state, county, parish, city etc. The other choice is a shot fired one, which will lead to the bloodshed of nothing but the scum in Washington, D.C. or Babylon as I refer to it, from the legislative branch, to the executive branch and the judicial branch. If one were to eye shoot a few international bankers, some Large corporation CEOs and Insurance company boards of directors, it could not hurt. Alas I am too, too old to take part in either, but I have confidence in the younger generation, maybe they will shoot some of the ex-hippies, who embraced the idea of a free lunch for all those able bodied but scurrilous degenerates who love welfare.
It is good to see that some of the representatives HAVE a pair, while others seem to be growing a pair. Imagine the AUDACITY of a federal gu’mint who writes and enacts a law that is completely unconstitutional, and then points to that unconstitutional law as proof that they have power over the states on this matter. The feds need a swift kick in the groin, and soon! The 10th amendment is very clear. “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” If the Constitution does not GRANT the power to the feds, then they don’t have SQUAT to say about it! Come on Kentucky! You other conservative “Shall-Issue” states! GET WITH THE PROGRAM! Tell the feds where they can stick it!

Wish I were in Montana, I wouldn’t hesitate to make a SBR/SBS or suppressor after 1 Oct….If I had the equipment. The way I see it, a SBR/SBS that is no shorter(as a starting point) than a bullpup firearm is not “dangerous and unusual”. I just hope the MSSA or someone in Tennessee doesn’t screw up the case they will eventually go forward with. It’s really a 2nd Amendment case more so than a commerce clause case. The feds will move forward under their commerce powers, and if MSSA does not use someone that is selling firearms but someone who makes it for him/herself, they should move forward with the legal argument that the 2nd Amendment allows one to make that which they have a right to own….Really, a no brainer. A right should aways trump ANY commercial endeavor. Wish I could help a little financially…but laid-off at the moment.
I am proud to be a co-sponsor of this valuable legislation in Montana and urge other states to follow us and Tenn before the current Administration begins disarming Americans to comply with the Internationalists’ demands. The Feds have already notified Tenn and Montana that they do not respect our state law so we need more states to re-enforce our 10th Amendment stand.

There exist at least major threats to life, liberty and the pursuit of happiness in these United States. These threats include those posed by criminals, by terrorists (both foreign and domestic) and by those who would seek to disarm Americans. It is clearly the latter who pose the greatest danger to our republic. Now, even the 9th Circuit Court of Appeals is revisiting its previous decision on firearms, if only to with a view to head off incorporation at the pass, as it were. The pass, of course, is the U.S. Supreme Court. Incorporation issues should be given to the high court, and then, at least our newest Supreme Court nominee would at least know that D.C. v Heller does apply to the states, and not just the federal enclave of Washington, D.C. Second, the BATFE can recall their letter, essentially depriving states of their rightful role in intrastate commerce. We should be thankful that these states stood up for making decisions for their residents that have been increasingly usurped by the federal government. Just for the edification of the far left, so preoccupied by the “radical right extremists”, favoring states rights is not yet a hanging offense in our country. Neither is supporting 2nd amendment guarantee by the Constitution, or concerns of excessive intrusion of federal controls over the lives of its citizens. This kind of thing does happen, when driving down the road in life, when government grows too large, spends money it does not have, and then makes a hard left, instead of going straight, or, heaven forbid, turns right. Now THAT would be change we could ALL live with, and make the framers of our Constitution proud. Heavens, anything less than that would be, well, tyranny, wouldn’t it? Are recent events evidence of the tyranny of the government over the governed? Alternatively, is is just garden variety socialism, where individualism, freedom of speech and the press, capitalism, property rights and all that icky stuff are just put on the back burner, permanently? Please think about it.

I taught Gov. at the H.S. level. My primary point was to teach the idea that the constitution was virtually a sacred document, especially the first Ten Amendments. I tried to stress the idea that these are the fondation of our democracy, and you don’t try to alter even one of the foundation blocks in fear that the entire constitution will crumble. These rights have worked for over 200 years why change.now. Is it change for the sake of change w/o regard to the aftermath. Alter the concept of the 2nd Amemdment, then what’s next, the 1st amendment? Oh, by the way, I’m a Democrat.

@ted cichecki I agree to all that you had to say with the exception of the use of one extremely important word. (democracy) I am happy that you have the views that you do. However you do need to clarify that we are not a democracy but a republic. There is a huge difference which I hope was one of the most important things you taught your students. Everyone needs to re-read the Pledge of allegience for a refresher now and then. We also need to remember that every state in the union was guaranteed a Republican form of government by the Constitution. Democracy was never mentioned once in the Constitution or Declaration of independence. On the contrary the founding fathers had an extreme dislike for “Democracy” as we can see by reading the Federalist Papers. For this to work it will have to be guns that are made and sold only in that state. If the manufacturer wants to sell to other states he will have to get an FFL, which puts him under the regulatory rules of ATFE. The FFL dealers will not be able to sell the weapons either as it would violate ATFE regulations. The FFL is a vountary license that is applied for with the federal government. The applicant agrees to abide by all local, state, and federal laws. In order for the dealer to recieve merchandise from the manufactures and or wholesalers and to have firearms shipped to his location from out of state he must have an FFL. Thus in Montana, a manufacturer of firearms that only sells guns in Montana to non FFL dealers who sell to the public would be legal. This leaves every gunshop out of the equation. Economically the implementation of this law is probably impossible.

The government is to be limited…no unlimited.

I am another “old man”, 76 and counting. While in High School world history class
we studied various government isms. Socialism of one sort or another is the root of
many/most of the worlds problems today. National Socialism was Germany’s version.
Communism was Russia’s version. Capitalism is not a government system. Many in the USofA bought into socialism and covertly and overtly worked hard and effectively to subvert our government. Senator Joseph McCarthy may have had his excesses but he was right on target. I have read several books dealing with Soviet espionage during the 20th century. Many of these books report information which was not available until after the collapse of the Soviet Union. (I am planning an anthology fo several of these books.)

If we allow this to happen we are doomed for perhaps all time.
The 10th Amendment challenge is an appropriate step in the right direction.

I see where my “great” state of Iowa is still behind times. Our Govenor and Legislature are to busy trying to find new ways of stealing our money(taxes) and keeping out new business. Oh, I forgot, our supreme court makes the laws for the state now because it would require the gov and legislature to actually work otherwise.

One reason that the preamble to the Bill of Rights is almost never published or talked about is that it destroys all arguments about Articles in the Constitution (treaties etc.) that are used to destroy our rights. To refresh our memory the preamble is as follows:
“Preamble
Congress OF THE United States
begun and held at the City of New York, on Wednesday
the Fourth of March, one thousand seven hundred and eighty nine.
THE Conventions of a number of the States having at the time of their adopting the Constitution, expressed a desire, in order to prevent misconstruction or abuse of its powers, that further declaratory and restrictive clauses should be added: And as extending the ground of public confidence in the Government, will best insure the beneficent ends of its institution
RESOLVED by the Senate and House of Representatives of the United States of America, in Congress assembled, two thirds of both Houses concurring, that the following Articles be proposed to the Legislatures of the several States, as Amendments to the Constitution of the United States, all or any of which Articles, when ratified by three fourths of the said Legislatures, to be valid to all intents and purposes, as part of the said Constitution; viz.:
ARTICLES in addition to, and Amendment of the Constitution of the United States of America, proposed by Congress, and ratified by the Legislatures of the several States, pursuant to the fifth Article of the original Constitution.”
The key phrase here about the body of the Constitution is “in order to prevent misconstruction or abuse of its powers, that further declaratory and restrictive clauses should be added”. That means that any clause, treaty or law that goes against the principles of the Bill of Rights is null and void, even if based on the Articles of the main Constitution. And yet, what BAR attorney uses this argument in Court to defeat treaties and laws that are in conflict with the Bill of Rights. Now you know why the preamble is seldom published or taught.
As Joe Sobran famously said “The Constitution poses no threat to our present form of government”.
A few points: once someone applies for and accepts an FFL, he agrees to dance to the BATFE’s tune, which means accepting their regulations as well as surrendering basic Constitutional rights such as the Fourth Amendment. An FFL is a contract in other words.
The larger question is where do the Feds get the authority to regulate firearms in the first place? US Attorney General Cummings claimed, in hearings on the NFA of 1934 before the House Ways and Means Committee (remember the NFA is a tax statute), authority based on the model of the Harrison Act which started the notably successful and neverending War on Drugs. This act introduced the novel idea of using the Commerce Clause and the taxing power as the controlling authority. Prior to this, it was generally thought that the Constitution had to be amended to grant authority prior to such actions such as Alcohol Prohibition. But drugs, unlike firearms, are not protected by their own constitutional amendment. Read the preamble to the Bill of Rights, (something you were probably never taught in school, on purpose of course):

The Bill of Rights was adopted after the Commerce Clause, so that its language is controlling, which explicitly says that the right to keep and bear arms “shall not be infringed”, period. If a poll tax is, by constitutional amendment, an infringement on the right to vote, then how can a firearms tax not be an infringement on the right to keep and bear arms? By the same logic which is self evident from the language of the Bill of Rights, the 9th and 10th Amendment trump any authority claimed by anything in the body of the original Constitution unless that authority has been specifically granted by later amendment (such as Alcohol Prohibition). Since the language is fairly clear, we are reduced to quibbling over the meaning of individual words, words which were apparently clear enough to everyone prior to the passage of the Volstead Act, but suddenly became clouded by the time of the FDR administration and the NFA of 1934 and have been ever since.
As a practical matter, the Federal Government feels itself bound to the Constitution as a matter of convenience only. When the Constitution cuts in the Feds’ favor they obey it; when not they ignore it or put some arcane interpretation on it and then make it practically impossible to challenge that interpretation. When things get really at an impasse, they call out the troops, as did Mr. Lincoln. So much for the Tenth Amendment.
Federal Gun Laws need to be challenged on Second Amendment grounds. Challenging on intra vs inter state commerce is still conceding to the Feds the authority to regulate firearms. This flies in the face of the Constitution and the Second Amendment.
I’m glad to see some official “pushback” like this from state legislatures against the federal government with respect to matters historically regulated by the states. I’m also glad to see that Florida is one of the states involved in this initiative. The United States is too large and diverse to have all matters down to the most minute detail regulated by a single far-off group of individuals. Where law and regulation are concerned, one size most definitely does not fit all.
It remains to be seen if the federal government will, under pressure of more and more states officially asserting their rights, clamp down and finally declare that there is no longer such a thing as “states’ rights”.

While we have a major assault on those God given rights is no time to go back and examine previous issues. You have to fight todays fight. I didn’t own slaves and neither did you. There isn’t an American slave alive anywhere. America has done some questionable things (Breaking the Treaty of 1868)but we must fight the good fight of faith now with today’s enemies. I thought that is what happened in 1865 and was the whole point of the 14th Amendment, that ex post facto justification for the War to Prevent Southern Independence.

On the other hand if he doesn’t sell it to you, he could still go to jail on State charges ?

NOTE: About 20% of the land area of the United States was given over to United Nation’s control on January 1st of 2000. This is when all of our National Parks were turned over to United Nation’s control by Executive order from President Clinton using the Emergency Presidential Powers he had taken on. Three months later the United Nations started restricting our access to certain areas of OUR OWN PARKS!

Shortly after 9/11 President Bush arranged for AWACS Planes with FOREIGN CREWS!! to examine the United States saying that none of ours were available. Thus all of our Air Bases, Military Command Bases, Weapon Storage Facilities Strategic Military Suppliers Factories, Cities, Water Sources, Bridges and our entire info structure was made available to Map by Foreign Countries which we may be soon engaged in battle with. In other words the European Union which is the base for the new United Nations World Government.
Also under NATO etc., we have exchanged some of our latest military information and even had crucial parts of our advanced aircraft manufactured in Europe! It is no wonder that some of their military aircrafts capability is now close to exceeding our own!
If that is not enough, the Majority of the Supreme Court recently betrayed the United States Constitution and the American People by stating that a person’s land may be taken from him if the local government believes that more taxes will come in from the new owners of the land that the government sells the land to! Our Forefathers who framed the Constitution felt that the right to own property was the most important foundation of the Country after being under God’s Protection.

However by the Grace of God we can win but we must act very soon or it will be to late to restore our United States Government back in place.
A good sign is that 7 Million people went for background checks to purchase guns during the first 100 days of 2009.
Since more than one gun can be purchased from the same dealer with a single background check this should translate into 12 to 15 million guns purchased in the first 100 days of 2009.
This does not include purchases from private parties during the same period which should add an additional 2 million guns purchased. This should give a total of 14 to 17 million guns purchased in the first 100 days.
Now since another 100 days have passed in this ever worsening situation were talking 28 to 34 million guns purchased by American Citizens so far in 2009! PRAISE GOD! (Cont. Below)
Now this is in addition to starting 2009 with approximately 100 to 120 Million guns already in the hands of American Citizens although some say it is closer to 200 million. This should make a total of the 100 to 120 million plus the 28 to 34 million to make a grand total of 128 million to 154 million guns that will be available for the upcoming WAR.
Now for ammunition:
Now if each gun owner has only 200 rounds of ammunition for his gun, (many have thousands), and there are 128 to 154 million guns we are talking 25 billion, 25,000,000,000 to 30 billion, 30,000,000,000 rounds of ammunition available for the upcoming WAR.
In addition I understand that many Ammunition Manufacturing companies are operating on around the clock shifts trying to keep up with the massive purchases of ammunition by our Citizens here in the United States of America.
Now I do not believe that Americans are just stocking up, but are rather preparing for the soon upcoming WAR right here in the United States of America between the Citizens and those Traitors in the Government who are trying to remove Our United States of America Republic which is: FOR AND BY THE PEOPLE UNDER GOD.
There are approximately 30 million trained killers in the United States.
Present and former Military, Hunters and some Police.
